Company Registration: Making it official

If you have decided to set up a company of your own, the first thing you should know is how to register it properly.

It is this registration procedure that, when done properly, will make sure that your company is treated as a legal entity. Read on to find some tips on registering your company properly.

 

  1. Choose the name: Once you have decided on the name of the company, confirm through the registration offices whether the name is available. If someone else has always registered the name, you will not be able to use it. Note that the type of your company will also play a role in the selection of name. For instance, you can’t have two companies in the same region named Acme Pvt. Ltd. But if you have an Acme Pvt. Ltd. and an Acme Corporation Ltd. in the same area, it is perfectly acceptable.

 

  1. File the docs: The next step would be to fill out all the necessary documents. Prepare the Memorandum of Association and the Articles of Association documents. These two docs must be prepared correctly and filed with the registration office in your city.

Fill out the forms: The next step would be to fill out certain forms that will state the nature of your company (Limited, Limited Partnership, Sole Proprietorship, Non-profit, etc.), the rights of the shareholders, the powers that the Director(s) will have, the physical address of your company, the address of the Company Secretary, and so on. In case you are establishing an LLC (Limited Liability Company), these forms will also contain the date of dissolution of the company. The names and official numbers of the forms vary from country to country. Consult your local registration office for more details.

 

  1. Pay the fees and file the receipt: After you pay the necessary fees to the registration office, you will get some document stating that payment of the fees has been done. You may have to file a copy of this document to the registration office as well. Ask the office personnel for more information regarding this.
