What is a durable power of attorney form? A durable power of attorney form is a legal and written document that individuals, organizations, or appointed personalities will have to fill-up in order to designate and name out an agent or an attorney-in-fact.  Simply speaking, a durable power of attorney form is a document that binds an attorney and an individual into a legal commitment.  With the power of this document, an individual indicates specific details and authorization regarding the power of an attorney to perform tasks as designated by the contract.  Furthermore, other people can also be authorized to act as a principal. 

But what does the word durable mean? In this case, durable indicates that an authorized legal agent or attorney can act on specified tasks when a principal or individual will be disabled or will not be able perform his or her tasks anymore.  During this time, the contract will now be activated and the agent can now act accordingly and legally. The agent can now have the legal right to decide on financial or business matters.  On the other hand, any decisions that could lead to legal issues by the attorney-in-fact will not make the principal responsible for it.  Any transactions made to a third party are the sole responsibilities of the agent.  

The durable power of attorney form can be of use during this time.  This form should have detailed provisions or sections on what are the responsibilities of an agent or attorney-in-fact.  There are also details on what the agent should do the moment the principal becomes disabled and incapacitated.  To make this form legal and binding, it should have the signatures of both the principal and attorney, witnessed by an authorized individual.  This individual has the right to give an oath, and thus this form can be now considered as a legal document.  Bear in mind though that an attorney-in-fact may not actually be an attorney, but can be a spouse, adult child, or relative.
