Important Information You Should Know Before Attending a Deposition

What goes on at a Deposition? Here is improtant information you should know before attending a Deposition.

Deposition Instructions:

1. Depositions are not conversations. Depositions are formal, legal proceedings. Be polite. If there is no question being asked of you, don’t say anything.

2. Be truthful.

3. Be as precise as you can.

4. Think before you answer. Make sure you understand the question. If you do not understand the question, ask for a clarification.

5. Do not volunteer information. Keep your answer short. When you give lengthy answers, you’re revealing more information and giving the Defendant’s attorney ideas for more questions.

6. Never guess. You might be wrong. If you don’t know the answer, say you do not know. Listen to the whole question before answering.

7. Do not get angry. Becoming angry sometimes will make you reveal too much information, and will send the message that you are ill-prepared to be a witness and cannot control yourself. The attorney for the other side will try to take advantage of that weakness at trial.

8. Stop talking when your attorney objects. Some questions are completely improper and should never get an answer.

9. If you are asked to review a document or photographArticle Search, do not answer any questions about the document or photograph until you have completely reviewed it.
