The litigation phase of the divorce process marks the close of the 'beginning phase' of your case and marks the start of the actual court room litigation phase of your case. Keep in mind that the litigation phase can be lengthy and tiresome. We have all heard horror stories about the divorces(celebrity divorces for example) that dragged on and on for months on end where it seemed that no end was in sight. The litigation process begins with the hiring of the right divorce lawyer. Secondly, after you have hired the right divorce lawyer, you will go ahead and file the divorce papers at the court house. Keep in mind that each court house charges a filing fee for filing divorce papers.
Third, you will attend some parenting classes (if children are involved in your case). If no children are involved in your case, then you will not be required to attend te classes but will instead be required to prepare for the initial hearing. Part of the 'preparation' process is producing income information to the opposing lawyer and providing proof of your current living arrangement.
Fourth, you will either engage in contested litigation, or you will attend mediation in order to try to settle outiside of court, or like in most cases you will engage in a mixture of the two in that you will engage in some contested litigation in the court room but you will also participate in some mediation sessions in order to try to facilitate a full and final settlement of the divorce.
Fifth and finally, you will complete a final divorce decree either by agreement or by order of the judge. Regardless of HOW it is completed, the completion of the final divorce decree will (in most cases) represent the finalization of your divorce.
