A recent recall issued by DePuy Orthopaedics,Recent DePuy Hip Replacement Recall Concerns Patients Articles Inc., a subsidiary company of Johnson & Johnson, in late August has stirred up quite a bit of concern with DePuy hip replacement patients. The recall includes DePuy’s ASR XL Acetabular System, which was used in total hip replacements, as well as DePuy’s ASR Hip Resurfacing System. The recall was issued after it was determined that the failure rate for both above mentioned systems exceeded 12%.

DePuy’s ASR XL system was introduced to the U.S. market in 2005, and DePuy advertised the ASR XL Acetabular Head System as “high performance”. In fact, the company showcased several advantages of this hip replacement system that seemed to far outweigh those of hip resurfacing and even the conventional hip replacement.

According to the XL DePuy ASR XL Head System: Metal-on-Metal Articulation patient education guide published in 2006, DePuy stated that the ASR allowed for greater preservation of the bone within the hip socket, that the incision required was much smaller, and that the replacement matched up to the natural anatomy of the hip. All of this was said to have been based on clinical history.

Of course, neither of the ASR systems performed as DePuy claimed. Instead of announcing a recall right off the bat, DePuy instead stopped selling the ASR XL system in late 2009 and finally pulled all of the ASR hip replacements that remained from inventory. DePuy insists that this decision was due to declining sales of the ASR XL and not due to the issues that were being reported by orthopedic surgeons, which included implant failure. However, to some, the company’s actions seem to constitute a silent recall.

The law firm of Vanguard Law Partners is being retained for this hip replacement recall by a number of individuals throughout the United States that have sustained injuries due to the failure of the ASR hip replacements. Vanguard Law Partners intends to prosecute the claims of these individuals against DePuy.

If you are experiencing problems with your DePuy ASR hip replacement device, you should strongly consider a consultation with an experienced hip attorney that is experienced with the liability of medical products. If you are planning to schedule a hip replacement revision surgery, it is wise to retain counsel prior to doing so to ensure that any potentially essential evidence is carefully preserved. The law limits the amount of time that individuals can file legal action for your failed DePuy ASR hip system. Don’t let time become your enemy.
